Welcome to Obsyk. These Terms of Service ("Terms") govern your access to and use of the Obsyk platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Obsyk provides a Kubernetes visibility and security platform that enables users to monitor, explore, and understand their Kubernetes clusters. The Service includes a lightweight operator that collects metadata from your clusters and a dashboard to visualize this information.

2. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to transmit malware or other harmful code
  • Resell or redistribute the Service without authorization
  • Use the Service in a way that could harm Obsyk or other users

4. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. The Obsyk operator collects metadata about your Kubernetes resources. We do not collect or store the contents of secrets, environment variables, or application data.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Obsyk and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service.

You retain all rights to your data. By using the Service, you grant Obsyk a limited license to process your data solely to provide the Service.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

7. Subscription and Payment

Certain features of the Service require a paid subscription. Payment terms are as follows:

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • Failure to pay may result in suspension or termination of your account

8. Free Tier

We offer a free tier with limited features. The free tier is provided "as is" and may be modified or discontinued at any time. Free tier accounts may be subject to usage limits.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Obsyk does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSYK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Obsyk, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
